YOUR CANNABIS BUSINESS IS ONLY AS STRONG AS YOUR LEGAL ADVISOR
Navvee has both cannabis business operational and legal experience and expertise to help your business excel.
The marijuana or cannabis industry is new and extremely dynamic. Although over 30 states have legalized cannabis for either medical or recreational purposes, it remains illegal at the federal level and that means there is a lot of uncertainty and complication involved in conducting a business in this industry.
Additionally, in the states in which cannabis is legal, the statutes and regulations and the regulatory processes that go along with it are being changed and refined on a regular basis as well. It requires constant diligence to remain in compliance.
Navvee has DIRECT experience in the cannabis industry, and by that we mean that our practitioners have been leaders of cannabis companies across cultivation (greenhouse and indoor), production and manufacturing, distribution and retail aspects of the business. We not only understand the business, we understand the legal and regulatory landscape, and we can help your business be successful.
Here are a few of the ways that we can assist you with the legal affairs of your cannabis business:
Just getting into the business can be a challenge. Every state has its own process for getting licensed to be in the marijuana business. Figuring that process out, using the right forms with the right information and getting them in to the right agencies at both the state and local levels is critical to success.
BUYING AND SELLING / TRANSFERS OF INTEREST
If you’re interested in getting involved in the marijuana or cannabis industry and your plan is to buy an existing business to get started, or, if you are already in the industry and either want to sell a part or all of your company, that often requires a distinct process as well.
Before you buy, before you sell, talk with Navvee about your plans and let us help get you on the right track. And then, during the sales process, let us help make sure that you will come through the process without a hitch, with the value that you expected, whether you are the buyer or the seller, in tact.
Compliance with applicable law is a critical part of running a successful cannabis business. There are reports that need to be filed, systems that need to be interacted with and updated, inspections that require ongoing efforts in order to pass, and much, much more.
Additionally, the requirements and reports and systems and processes vary from state to state as well.
Navvee can help you understand the requirements, set up your compliance processes and team, and get on track to being compliant on an ongoing basis.
While industrial hemp is now legal at the federal level under the 2018 Farm Bill, it is not without its own challenges.
Every state has its own set of registration requirements in order to comply with the federal law.
Some states continue to ban hemp from even being transported across their state lines.
And a high percentage of people can’t even tell hemp from its federally illegal cousin, cannabis.
Additionally, the active component that many companies extract from the Hemp plant, cannabidiol, or CBD, has to fall within specific content guidelines. Once again, the law is constantly being reviewed and refined by the regulatory agencies that are responsible for it. Of particular interest is the FDA’s approval of CBD as the active ingredient in at least one approved drug, which has caused a series of issues for other CBD companies around labeling and marketing.
We get it. It’s complicated. And we can help.
Give us a try. Remember: the consultation is free — no “marijuana tax” involved.
